Insurance company repaid

A woman from Summerhill was ordered to repay AXA Insurance a total of
€2,201.22 as the cheque for an insurance claim was issued to her in
error.
AXA Insurance took the civil case against Lisa Farrelly of Castle
Lawns in Summerhill at last Friday’s (18th January) sitting of Trim
District Court.
Terry Dowling, a Claims Inspector explained to Judge John Brophy that
following an RTA on 1st February 2006 at Summerhill between Ms
Farrelly and another car, an invoice for €2,327.22 for the estimated
damage to Ms Farrelly’s was sent to the insurance company from William
Elliott Accident Repairs. A cheque for €2201.22 (€126 less than the
estimate stated) was issued to William Elliott Accident Repairs to
carry out the work.
“An error was made making the cheque €126 less than what it should
have been. We deducted the policy excess when this shouldn’t have
happened,” Mr Dowling told the court.
Subsequently, a further cheque was issued directly to Ms Farrelly due
to a clerical error.
Due to the two errors of issuing cheques, Judge Brophy exclaimed, “I’m
going to insure with AXA!”
Mr Dowling told the court that contact was made with Ms Farrelly and
she told AXA she lodged the cheque to her account and agreed to pay
the money directly to the garage and the garage would pay AXA.
“This didn’t happen,” said Mr Dowling. Judge Brophy then ordered Ms
Farrelly, who was not in court, to repay AXA Insurance an amount of
€2201.22, plus costs.
